PLEASE READ THESE TERMS CAREFULLY BEFORE USING OPENTRIBE. BY ACCESSING OR USING OUR PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
1. Definitions
For purposes of these Terms:
- "Platform" means the Opentribe website (https://opentribe.io), dashboard, mobile applications, and all related services
- "We," "us," "our," "Opentribe" means Eva Interactive Co., a company registered in India
- "User," "you," "your" means any person or entity using the Platform
- "Builder" means an individual contributor seeking opportunities on the Platform
- "Organization" means an entity posting or managing opportunities
- "Opportunity" means any grant, bounty, or RFP listed on the Platform
- "Grant" means funding opportunities, including official Polkadot Grant Programs
- "Bounty" means task-based opportunities with defined rewards
- "RFP" means a Request for Proposal
- "Submission" means a Builder's work product submitted for a Bounty
- "Application" means a Builder's proposal for a Grant or RFP
- "Content" means any text, images, code, files, or other materials posted on the Platform
- "Aggregator" means a platform that displays opportunities from external sources
- "Opportunity Creator" means the entity that creates and funds an opportunity (e.g., Polkadot Treasury, Organizations, DAOs)
2. Platform Role and Limitations
2.1 Opentribe is an Aggregator Platform
CRITICAL: Opentribe aggregates and displays opportunities from the Polkadot ecosystem and partner organizations. WE DO NOT CREATE, MANAGE, OR FUND THE OPPORTUNITIES listed on our Platform.
2.2 What This Means
No Payment Responsibility:
- We do NOT hold, process, guarantee, or facilitate payments
- All payments are made directly by Opportunity Creators (Polkadot Treasury, Organizations, DAOs, etc.)
- We have NO control over payment amounts, timing, or methods
No Opportunity Creation:
- We display opportunities created by third parties
- We do not vet, endorse, or verify opportunity details
- We are not responsible for opportunity accuracy, changes, or cancellations
No Work Guarantee:
- We do not guarantee opportunity availability or acceptance of applications
- We do not guarantee selection of winners or approval of proposals
- Opportunity Creators make all selection decisions independently
No Fund Control:
- We have NO access to grant funds, bounty rewards, or any payments
- These are managed entirely by Opportunity Creators
- Payment failures are between Users and Opportunity Creators
No Contract Enforcement:
- We cannot enforce agreements between Users and Opportunity Creators
- All disputes must be resolved directly between the parties involved
- We may provide optional assistance but have no obligation to mediate
No Fiduciary Duty:
- We owe no fiduciary duty to any User or Opportunity Creator
- Our role is limited to aggregation and platform provision
2.3 Platform Services Limited To
- Displaying publicly available opportunities from the Polkadot ecosystem
- Providing tools for applications and submissions
- Facilitating community connections
- Curating and organizing ecosystem opportunities
- Providing a user-friendly interface
2.4 Platform Funding
Opentribe is funded by the Polkadot Open Source Grants program. We do not charge Users fees for platform usage.

All agreements regarding work, deliverables, payment, intellectual property, timelines, and terms are solely between Users and the Opportunity Creators (Polkadot Treasury, Organizations, DAOs, etc.).
3. Acceptance of Terms
By accessing or using Opentribe, you:
- Acknowledge that you have read and understood these Terms
- Agree to be legally bound by these Terms
- Represent that you have the authority to enter into these Terms
- Are at least 13 years of age (or 16 in the European Economic Area)
If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Description of Service
Opentribe is a talent marketplace aggregator for the Polkadot ecosystem that:
- Aggregates grants, bounties, and RFPs from across the Polkadot ecosystem
- Provides a centralized platform for builders to discover opportunities
- Facilitates applications and submissions through a user-friendly interface
- Connects builders with organizations and projects in the ecosystem
- Provides community features (comments, votes, discussions)
Important: We are an aggregator. Opportunities are created and managed by external parties, not by Opentribe.
5. User Accounts
5.1 Account Types
Builder Accounts:
- For individuals seeking opportunities
- Can apply to grants, submit to bounties, propose for RFPs
- Can create profiles showcasing skills and experience
Organization Accounts:
- For entities managing teams and opportunities
- Can submit opportunities for listing (subject to approval)
- Can manage team members and roles
5.2 Registration
To use certain features, you must:
- Provide accurate, current, and complete information
- Maintain and update your information
- Choose a unique username
- Provide a valid email address
Authentication Methods:
- Email and password
- Google OAuth
- GitHub OAuth
- Web3 wallet connection (for certain features)
5.3 Account Security
You are responsible for:
- Maintaining confidentiality of your credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access
- Using strong passwords and enabling multi-factor authentication (if available)
We are NOT liable for losses from unauthorized use of your account.
5.4 Account Accuracy
You represent that:
- All registration information is accurate and truthful
- You will maintain the accuracy of your information
- You have the right to use any content you submit
- You are not impersonating another person or entity
6. User Responsibilities
6.1 For All Users
You agree to:
- Provide accurate information in your profile and communications
- Treat other users with respect and professionalism
- Comply with all applicable laws and regulations
- Respect intellectual property rights
- Not engage in fraudulent or deceptive practices
- Pay all applicable taxes on your activities
- Use the Platform in good faith
6.2 Additional Builder Responsibilities
As a Builder, you agree to:
- Submit only original work that you own or have rights to
- Meet deadlines and commitments you make
- Communicate clearly and professionally
- Disclose any conflicts of interest
- Provide truthful information about your skills and experience
- Understand that Opportunity Creators make selection decisions
- Accept that payment is the sole responsibility of Opportunity Creators
6.3 Additional Organization Responsibilities
As an Organization, you agree to:
- Provide accurate opportunity information
- Clearly define requirements and deliverables
- Review applications and submissions in a reasonable timeframe
- Communicate decisions to applicants
- Understand that listing opportunities is subject to Platform approval
- For opportunities you create on Opentribe: Follow through on commitments and handle all payments directly with Builders
- For aggregated opportunities you post: Ensure accuracy and provide contact information for the actual opportunity creator
7. Payment Terms
7.1 Platform Fees
NO FEES: Opentribe is currently free to use. We do not charge fees for:
- Creating an account
- Browsing opportunities
- Submitting applications
- Making submissions
- Listing opportunities (subject to approval)
Future Fees: We reserve the right to introduce fees in the future with 30 days advance notice.
7.2 Opportunity Payments
All payments for opportunities are the sole responsibility of Opportunity Creators, NOT Opentribe.
Grant Payments:
- Grants are administered by Polkadot Treasury or official grant programs
- Payment timing, milestones, and terms are set by the grant program
- Opentribe has NO control over grant funds or disbursement
- For questions about grant payments, contact the official grant program
Bounty Payments:
- Bounties are funded and managed by the posting Organization
- Organizations are solely responsible for paying winners
- Payment amounts, currency, and timing are determined by the Organization
- Opentribe does NOT hold funds, act as escrow, or facilitate payments
- Payment disputes must be resolved directly with the Organization
RFP Payments:
- Payment terms are negotiated between Builder and Organization
- Opentribe is not involved in payment processing or enforcement
7.3 Cryptocurrency Payments
If payments are made in cryptocurrency:
- All transaction fees (gas fees) are the responsibility of the payer
- You must provide a valid wallet address
- Cryptocurrency payments are irreversible - verify addresses carefully
- No refunds for incorrect addresses or lost transactions
- Cryptocurrency income may be taxable in India
7.4 Tax Obligations
You are solely responsible for all taxes arising from your use of the Platform.
For Builders in India:
- Report all income received (cryptocurrency and fiat) to tax authorities
- Pay applicable income tax and TDS as per Income Tax Act, 1961
- Maintain records of all earnings and transactions
- Consult a tax professional regarding self-employment obligations
For Organizations in India:
- Issue tax forms as required (e.g., Form 16A for TDS)
- Deduct TDS if applicable under Indian tax law
- Maintain proper accounting records
- Comply with GST requirements if applicable
We do not provide tax advice. Consult a qualified tax professional.
8. Intellectual Property
8.1 Work Product Ownership
Default Rule: Unless otherwise agreed between Builder and Opportunity Creator, Builders retain ownership of their Submissions and Applications.
License Grant: By submitting work, Builder grants the Opportunity Creator a license to use the work as specified in the opportunity terms.
Pre-Agreement Essential: Builders and Opportunity Creators should clearly agree on IP ownership BEFORE work begins. Opentribe cannot resolve ownership disputes.
8.2 Open Source Opportunities
Opportunities marked as "Open Source" require Builders to license their work under the MIT License, unless otherwise specified in the opportunity terms.
MIT License (Default for Open Source Work):
Permission is hereby granted, free of charge, to any person obtaining a copy
of this software and associated documentation files (the "Software"), to deal
in the Software without restriction, including without limitation the rights
to use, copy, modify, merge, publish, distribute, sublicense, and/or sell
copies of the Software, and to permit persons to whom the Software is
furnished to do so, subject to the following conditions:
The above copyright notice and this permission notice shall be included in all
copies or substantial portions of the Software.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
8.3 Platform Intellectual Property
Opentribe Owns:
- The "Opentribe" name, logo, and trademarks
- Platform design, code, and architecture
- Documentation and marketing materials
- Original content created by Opentribe
Your License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose.
Restrictions: You may NOT:
- Reverse engineer, decompile, or disassemble the Platform
- Scrape or extract data via automated means without permission
- Remove copyright, trademark, or other proprietary notices
- Use Opentribe trademarks without written permission
- Create derivative works based on the Platform
- Sell, rent, lease, or sublicense your access
8.4 User-Generated Content
You Retain Ownership of:
- Your profile information and bio
- Your comments, forum posts, and discussions
- Your applications and submissions
- Your reviews and votes
License to Opentribe: By posting content, you grant Opentribe a worldwide, non-exclusive, royalty-free, sublicensable license to:
- Display, reproduce, and distribute your content on the Platform
- Modify content for formatting and technical purposes
- Use content for marketing and promotional purposes
- Create derivative works to improve the Platform
You Can Delete: You may delete your content at any time through your account settings.
Content Warranties: You warrant that:
- You own or have rights to all content you post
- Your content doesn't infringe third-party rights
- Your content complies with these Terms and applicable law
9. Acceptable Use Policy
9.1 Prohibited Activities
You may NOT:
Fraud & Misrepresentation:
- Provide false information in your profile or applications
- Impersonate another person, organization, or entity
- Submit plagiarized or stolen work as your own
- Post fake opportunities or misleading information
- Create sybil accounts or manipulate voting
Intellectual Property Violations:
- Infringe copyrights, trademarks, patents, or trade secrets
- Use unlicensed software, assets, or code in submissions
- Submit work you don't own or have rights to use
Financial Crimes:
- Engage in money laundering or terrorist financing
- Violate securities laws or regulations
- Conduct fraudulent transactions
- Evade taxes or engage in fraudulent tax reporting
Platform Manipulation:
- Create fake accounts or use bots to manipulate activity
- Engage in vote manipulation or fake reviews
- Send spam or unsolicited marketing messages
- Collude with others to manipulate bounty or grant outcomes
- Game or exploit platform features
Harmful Conduct:
- Harass, threaten, or bully other users
- Discriminate based on race, religion, gender, nationality, disability, or other protected characteristics
- Post violent, hateful, or extremist content
- Share others' private information without consent (doxxing)
- Post sexual content or engage in exploitation
Security Violations:
- Hack or attempt unauthorized access to the Platform or user accounts
- Distribute malware, viruses, or malicious code
- Conduct DDoS attacks or disrupt Platform services
- Phish, social engineer, or trick users
- Circumvent security measures or access controls
System Abuse:
- Scrape or automatically extract data without permission
- Reverse engineer Platform code or functionality
- Use the Platform for unintended purposes
- Make excessive API requests or overwhelm systems
- Interfere with other users' access to the Platform
Legal Violations:
- Violate Indian laws, including:
- Information Technology Act, 2000
- Indian Penal Code, 1860
- Copyright Act, 1957
- Trade Marks Act, 1999
- Income Tax Act, 1961
- Violate laws of your jurisdiction
- Engage in illegal activities or promote illegal conduct
9.2 Content Moderation
Platform Rights: We may, but are NOT obligated to:
- Review content before or after posting
- Remove content that violates these Terms
- Suspend or terminate accounts for violations
- Report illegal activity to authorities
- Investigate suspicious activity
No Obligation: We are not responsible for monitoring all user content. We act as an intermediary under Section 79 of the IT Act, 2000.
Appeals: If your content is removed or account suspended:
- Email legal@opentribe.io with "Appeal" in subject
- Include your account details and reason for appeal
- We will review and respond within 14 days
Repeat Violations: Accounts with repeated violations will be permanently banned without refund or prior notice.
9.3 Copyright Infringement (DMCA / Indian Copyright Act)
To Report Copyright Infringement: Email: legal@opentribe.io with "Copyright Infringement" in subject
Include:
- Description of the copyrighted work
- URL of the infringing content on Opentribe
- Your contact information
- Statement of good faith belief of infringement
- Statement under penalty of perjury that information is accurate
- Physical or electronic signature
Counter-Notice: If your content was removed for alleged infringement, you may file a counter-notice to legal@opentribe.io.
Repeat Infringer Policy: We terminate accounts with repeated copyright violations in accordance with the Copyright Act, 1957 and IT Act, 2000.

10. Disclaimers and Warranties
10.1 "AS IS" Service
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We Specifically Disclaim All Warranties, Including:
Service Quality:
- Availability, reliability, or uninterrupted access
- Error-free operation or bug-free code
- Compatibility with your devices or software
- Meeting your specific requirements
Content Accuracy:
- Accuracy of opportunity information (provided by Opportunity Creators)
- Accuracy of user-generated content
- Completeness or timeliness of information
User Interactions:
- Quality of work submitted by Builders
- Financial capability or reliability of Opportunity Creators
- Professionalism or conduct of other users
- Successful completion of projects
Blockchain & Web3:
- Reliability of blockchain networks (Polkadot, etc.)
- Transaction success or finality
- Gas fee stability or predictability
- Wallet compatibility or security
Third Parties:
- Actions of Opportunity Creators (Polkadot Treasury, Organizations)
- Payment fulfillment by Opportunity Creators
- Legality of opportunities in your jurisdiction
- Compliance of opportunities with applicable laws
10.2 No Guarantees
We Do NOT Guarantee:
- That you will be selected for opportunities
- That Opportunity Creators will pay you
- That opportunities will remain available or unchanged
- That the Platform will be uninterrupted or secure
- That errors will be corrected promptly
10.3 Your Acknowledgment
By using Opentribe, you acknowledge:
- Opportunities are created and managed by third parties
- Payment is the sole responsibility of Opportunity Creators
- We are an aggregator with no control over outcomes
- You participate in opportunities at your own risk
11. Limitation of Liability
READ THIS CAREFULLY - IT LIMITS OUR LIABILITY TO YOU.
11.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
- ₹10,000 (Ten Thousand Indian Rupees), OR
- The amount you paid to Opentribe in the 12 months prior (currently ₹0)
11.2 Excluded Damages
WE ARE NOT LIABLE FOR:
Indirect Damages:
- Loss of profits, revenue, or business opportunities
- Loss of data, information, or goodwill
- Reputational harm or damage
- Loss of expected savings or investments
Consequential Damages:
- Failed or delayed payments by Opportunity Creators
- Work rejection or non-selection by Opportunity Creators
- Missed deadlines or opportunities
- Project cancellations or changes
- Opportunity unavailability
Aggregator-Specific:
- Accuracy or completeness of aggregated opportunity information
- Actions or omissions of Opportunity Creators (Polkadot Treasury, Organizations, DAOs)
- Payment failures or disputes between Users and Opportunity Creators
- Changes or removal of opportunities by creators
- Quality of opportunities or work products
Web3 & Blockchain:
- Blockchain network failures, congestion, or downtime
- Smart contract bugs, exploits, or failures
- Wallet hacks, security breaches, or loss of private keys
- Cryptocurrency value fluctuations or volatility
- Gas fee increases or transaction failures
- Failed or irreversible transactions due to user error
Third-Party Actions:
- Actions of other users (Builders, Organizations)
- Third-party service failures (Sentry, PostHog, Vercel, etc.)
- OAuth provider outages (Google, GitHub)
- Email delivery failures (Resend)
- Database or hosting issues
Force Majeure:
- Natural disasters, pandemics, or acts of God
- War, terrorism, civil unrest, or government actions
- Internet or telecommunications infrastructure failures
- Cyberattacks, hacking attempts, or security breaches beyond our control
- Power outages or equipment failures
11.3 Jurisdictional Variations
Some jurisdictions do not allow limitations on implied warranties or liability for certain types of damages. If you reside in such a jurisdiction, these limitations apply to the maximum extent permitted by law.
11.4 Fair Allocation of Risk
This limitation reflects the nature of our service as a free aggregator platform with no control over opportunities or payments.
12. Indemnification
12.1 Your Indemnification of Opentribe
You agree to indemnify, defend, and hold harmless Opentribe, Eva Interactive Co., our officers, directors, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your applications, submissions, or content
- Your interactions with other users or Opportunity Creators
- Your breach of these Terms
- Your violation of any law or third-party rights
- Your negligence or willful misconduct
- Any payments you make or receive related to opportunities
12.2 Process
We will notify you of any claim subject to indemnification and may participate in the defense at our expense.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Jurisdiction: Courts of New Delhi, India shall have exclusive jurisdiction.
13.2 User-to-User Disputes
For disputes with other Users or Opportunity Creators:
We Encourage:
- Good faith attempts to resolve disputes directly
- Clear communication and documentation
- Mutual understanding of terms before work begins
Our Role:
- We may offer assistance or information
- We are NOT obligated to mediate or resolve disputes
- We have NO liability for User-to-User disputes
You Release Opentribe: From any claims arising from disputes with other Users, Opportunity Creators, or third parties.
13.3 User-Platform Disputes
Informal Resolution (Mandatory): Before filing any legal claim, you must contact legal@opentribe.io and attempt informal resolution for 30 days.
Arbitration (for claims over ₹5,00,000): For claims exceeding Five Lakh Indian Rupees (₹5,00,000):
- Disputes shall be resolved through binding arbitration
- Arbitration governed by Arbitration and Conciliation Act, 1996
- Seat of arbitration: New Delhi, India
- Language: English
- Number of arbitrators: One (1), mutually agreed upon
- Costs: As determined by the arbitrator
Small Claims (for claims under ₹5,00,000): For claims under Five Lakh Rupees, you may file in appropriate courts of New Delhi, India.
Opt-Out (Limited Time): You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@opentribe.io with "Arbitration Opt-Out" in subject.
Injunctive Relief: Either party may seek injunctive or equitable relief in court for:
- Intellectual property violations
- Confidentiality breaches
- Urgent matters requiring immediate action
13.4 Limitation Period
You must file claims within ONE (1) YEAR of the cause of action arising, as per the Limitation Act, 1963, or be forever barred.
13.5 Class Action Waiver
IMPORTANT: YOU AGREE TO BRING CLAIMS INDIVIDUALLY ONLY. You waive any right to participate in class actions, class arbitrations, or representative proceedings.
This waiver is material to our agreement.
14. Termination
14.1 Your Right to Terminate
You may:
- Close your account at any time through account settings
- Email legal@opentribe.io to request account closure
Upon Termination:
- You remain responsible for any outstanding commitments
- Your data will be handled per our Privacy Policy
- You may request data deletion (subject to legal retention requirements)
14.2 Our Right to Terminate
We may suspend or terminate your account:
Immediate Termination (No Notice):
- Material breach of these Terms
- Fraudulent, illegal, or harmful activity
- Threat to Platform security or other users
- Court order or legal requirement
With Notice (for non-material breaches):
- 14 days notice to cure minor violations
- Opportunity to appeal or explain
No Refunds: Terminated accounts forfeit any fees paid (when fees are introduced).
14.3 Effect of Termination
What Happens:
- Your license to use the Platform terminates immediately
- You must cease all use of the Platform
- We may retain certain data as permitted by our Privacy Policy
- Outstanding obligations (indemnification, liability limitations) survive
Surviving Provisions: The following sections survive termination:

- Disclaimers (Section 10)
- Limitation of Liability (Section 11)

14.4 No Continuing Obligation
After termination, we have no obligation to:
- Maintain or provide access to your account
- Forward communications or content to you
- Maintain your data beyond legal requirements
15. Changes to Terms
15.1 Modifications
We reserve the right to modify these Terms at any time.
Notice:
- Material changes: 30 days advance notice via email or Platform notification
- Non-material changes: Posted on this page with updated "Last Updated" date
Acceptance:
- Continued use after changes = acceptance
- If you disagree, you must stop using the Platform
Right to Terminate: If you disagree with material changes, you may terminate your account before the effective date.
15.2 Review Regularly
We encourage you to review these Terms periodically for updates.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Opentribe regarding use of the Platform.
16.2 Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
16.4 Assignment
You may NOT assign or transfer these Terms or your rights under them.
We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, with notice to you.
16.5 Force Majeure
We are not liable for failure to perform due to events beyond our reasonable control, including:
- Natural disasters, pandemics, or acts of God
- War, terrorism, or government actions
- Internet or telecommunications infrastructure failures
- Cyberattacks or hacking beyond our control
16.6 Independent Contractors
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between users and Opentribe.
16.7 No Third-Party Beneficiaries
These Terms are for the benefit of the parties only. No third party has rights to enforce these Terms.
16.8 Headings
Section headings are for convenience only and do not affect interpretation.
16.9 Language
These Terms are in English. Translations may be provided for convenience, but the English version governs in case of conflict.
